What we collect
When you send an enquiry, we receive what you typed into the form: your name, your phone number, your email address where the form asks for one, your budget if you gave one, and the page or project you sent it from. Nothing else on this site asks you for personal data — you can browse the whole catalogue without identifying yourself. Filling the form in is voluntary, but without those details we cannot answer you.
Like every web server, ours keeps technical logs: IP address, browser user-agent, the pages requested and when. These we process on the basis of our legitimate interest in keeping the service secure and available (RGPD art. 6.1.f); they are not combined with enquiry data to build a profile of you.
Why we use it, and on what legal basis
We answer your enquiry, and prepare suggestions that fit what you asked for, on the basis of the steps taken at your request before any contract (RGPD art. 6.1.b). The consent you give with the form covers our contacting you with further suggestions afterwards (art. 6.1.a). Analytics and marketing cookies rest on your consent alone (art. 22.2 LSSI-CE and RGPD art. 6.1.a), and you can withdraw it at any time.
Who else sees it
Your enquiry goes to our own sales team and to the CRM and messaging providers the agency runs on. Where a service provider processes data for us, it does so under a written processing agreement and only on our instructions.
Some of these providers, and also Google and Meta, are established outside the European Economic Area. Those transfers rely on a European Commission adequacy decision where one applies — for the United States, the EU–US Data Privacy Framework — and otherwise on the Commission's standard contractual clauses. Write to us at the address above for a copy of those safeguards.
We do not sell personal data, and we do not pass it to advertising networks or to third parties for their own marketing.
How long we keep it
Enquiries are kept for as long as it takes to deal with them and for as long as you remain in contact with us, and after that for the periods Spanish commercial and tax law requires — as a rule four years for tax purposes and six under the Commercial Code. Server logs are kept for 30 days and then deleted. If you ask us to delete your data, we delete it except where the law requires us to hold it.
Cookies and similar technologies
Cookies are small files a site stores in your browser. We group them as Spanish and EU rules require (art. 22.2 LSSI-CE and the RGPD), and only the first group is set without asking you:
- Strictly necessary — one cookie, which remembers the choice you made in this banner. It cannot be switched off and requires no consent.
- Analytics — Google Analytics 4, used to count visits and see which pages and searches people actually use. Set only if you accept them.
- Marketing — the Meta (Facebook and Instagram) pixel, used to measure our advertising and to show ads to people who have looked at similar properties. Set only if you accept them.
Until you accept, no analytics or marketing cookie is written. You can change your mind at any time through the cookie settings in the site footer, and you can delete or block cookies in your browser settings — the catalogue keeps working either way.
| Cookie | Set by | What it does | Expires |
|---|---|---|---|
| nd_consent | newdevelopment.es | Remembers your cookie choice so we stop asking | 1 year |
| _ga | Google Analytics | Tells one visitor apart from another | 2 years |
| _ga_<ID> | Google Analytics | Keeps the state of the current visit | 2 years |
| _fbp | Meta | Identifies the browser to measure our ads | 3 months |
| _fbc | Meta | Records which of our ads a visit arrived from | 3 months |
The cookies below the first one appear only after you accept the corresponding category, and are deleted when you withdraw that consent. We ask again a year after your last answer, so that a choice made once does not last indefinitely.
For Google Analytics, Google acts as our processor under its data processing terms. For the Meta pixel, we and Meta are joint controllers of the collection and transmission of the data, and Meta alone decides what it does with the data afterwards. What that is, is governed by their own policies: policies.google.com/privacy and www.facebook.com/privacy/policy.
We make no automated decisions that produce legal effects for you or similarly affect you significantly (RGPD art. 22). If you accept marketing cookies, Meta may use them to choose which of our ads you are shown; nothing you see on this site, and no price on it, depends on a profile of you.
The properties you save are kept in your browser's local storage, not in a cookie. No consent is needed for it, because it exists only to provide a feature you asked for (art. 22.2 LSSI-CE): the list is never sent to our server and disappears when you clear the site's data.
Maps and other content loaded from elsewhere
When you open a map, your browser fetches the map tiles directly from OpenFreeMap and CARTO, which receive your IP address, as any server does when your browser requests a file from it. CARTO is established outside the European Economic Area; that transfer relies on the European Commission's standard contractual clauses. We send them nothing else about you, and maps load only on the pages where you open them.
Your rights
You can ask us for a copy of your data, to correct it, to delete it, to restrict how we use it or to object to it, and to receive it in a structured, commonly used and machine-readable format. You can withdraw consent at any time, without affecting the lawfulness of processing carried out on that basis before you withdrew it.
Write to info@newdevelopment.es with enough detail for us to establish who you are; we answer within one month. If you believe we have handled your data badly, you can complain to the Spanish supervisory authority — the Agencia Española de Protección de Datos, C/ Jorge Juan 6, 28001 Madrid (www.aepd.es) — or to the supervisory authority of the country where you live or work (RGPD art. 77).
Children
This site is aimed at property buyers and is not directed at children. We do not knowingly collect data from anyone under 16 — the age at which a person can consent on their own varies across Europe, and we apply the highest of them.
Changes to this policy
When our data practices change, this page changes with them, and the date at the top of it changes too. Where we hold your contact details and a change materially affects how we use data you have already given us, we will tell you directly; otherwise the change is announced here.
